DMCA Policy for Sierra Daily

Sierra Daily (“we,” “us,” or “our”) respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we have adopted the following policy to address claims of copyright infringement.
1. Notification of Copyright Infringement
If you are a copyright owner or an agent thereof and believe that any content on Sierradaily.com (the “Site”) infringes upon your copyrights, you may submit a notification pursuant to the DMCA by providing our Designated Copyright Agent with the following information in writing:
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., the URL of the page on our Site).
- Your contact information, including your name, address, telephone number, and, if available, an email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
Failure to include all of the above information may result in a delay in processing your DMCA notification.
2. Takedown Procedure
Upon receipt of a valid DMCA notification as described above, Sierra Daily will:
- Promptly remove or disable access to the allegedly infringing material.
- Notify the user or content provider who posted the material that we have removed or disabled access to it.
3. Counter-Notification Procedure
If you believe that your content was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our Designated Copyright Agent. To be effective, a counter-notification must be a written communication that includes the following:
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access was disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if your address is outside of the United States, for any judicial district in which Sierra Daily may be found), and that you will accept service of process from the person who provided the original infringement notification or an agent of such person.
- Your physical or electronic signature.
Upon receipt of a valid counter-notification, we may, in our discretion, send a copy to the original complaining party informing them that we may replace the removed material or cease disabling it in 10 business days. Unless our Designated Agent first receives notice from the original complaining party that they have filed an action seeking a court order to restrain the alleged infringer from engaging in infringing activity, we may replace the removed material or cease disabling access to it within 10 to 14 business days.
4. Repeat Infringer Policy
In accordance with the DMCA and other applicable law, Sierra Daily has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also at our sole discretion limit access to the Site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
